By continuing to browse and use the website, you are agreeing to our following Terms and Conditions. These are the terms and conditions under which “House of Hummingbird” (the supplier) supplies vintage, antique and other products and services through its website www.houseofhummingbird.co.uk  to “you” (the customer).

Please take your time to read them.  Your statutory rights as a consumer are not affected. By entering into a financial transaction with us, House of Hummingbird, you are agreeing to be bound by our Terms and Conditions and that you have understood them.  

Goods

The description of goods on www.houseofhummingbird are for illustrative purposes alone.  Where goods are sold by description, such description is provided as accurately as possible according to our knowledge, of their detail, age, and any defects that we are aware of. Where our goods are sold as displayed or depicted, the pictures used are high quality images, taken from different angles if relevant, and measurements to show each product as accurately as possible on our website. However, because of the variables in calibration of various screens, computer monitors, and internet access variations may occur, in particular colour representation. If you require clarification of a particular product or aspect of the product then please ask at the time of purchase.

 

Given the history and age of our goods, they are not sold with any usual or specific purpose other than as an object of antiquity. You, the customer, are aware the goods that we sell on our website are vintage or antique and as such are sold in vintage or antique condition. There may be slight age-related wear and tear. You acknowledge that we do not provide any guarantee or warranty for the goods as to their purpose, accuracy, age or completeness. All goods that appear on our website are subject to availability.

Purchase of Goods or Service

The description of goods on our website and any other form of advertisement does not constitute a contractual offer to sell the goods.  When an order is placed and submitted on the website, we can either accept or reject it. We do not have to give any reason for rejection of an offer to buy. 

The order of purchase of goods is set out on our website.  Each step allows you the customer, to check and amend information or errors before you submit your order.  It is your responsibility to check that you have used the ordering process correctly. Once an order has been placed, confirmation by House of Hummingbird will be sent via email to you the customer, at the email address provided by you. Confirmation emails will be sent within a reasonable period of time. The receipt of this email confirmation forms the contract for the sale of goods. It is the customers responsibility to check that the content of this confirmation email is accurate and complete. House of Hummingbird will not be responsible for any inaccuracies in an order placed by the customer. If however, there is an error, you the customer, must inform us immediately. 

Any variation of the contract terms made after the contract has been agreed, can only be made if both the customer and supplier agree to the variation, and such variation is made in writing. 

Price 

The price of goods and of any additional delivery is as set out on the website at the date of the order.  If however we have made a mistake, then we will refund you and resell the product to you at the correct price. The price of the product is the exact price for the product itself, and does not include post package and or delivery cost.

 

 The cost of delivery and post and  websites does not signify that we endorse that site, we have no control over the content of those sites.

 

Payment

 Payment is made at the time of sale and prior to dispatch of the goods to you.

The customer must use a valid payment card accepted by us to make payment for goods.

Make sure you enter all of your details correctly including full name, email address, phone number, delivery and billing address, payment details and any other information requested at the point of sale at the checkout.

By making a purchase with House of Hummingbird, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to, your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise payment of goods or services.

 

If for any reason the payment is declined by your card issuer and if the amount is not received in full, House of Hummingbird reserves the right to withhold the products and/or cancel the contract.

Please always check that you close down your Internet browser when you have finished shopping.

Take note to avoid entering payment details on public computers or in the presence of other people.

 House of Hummingbird may wish to contact you by email from time to time, however we would never send an email asking for your security information, log on details, payment details or direct you to a web page that asks for this information. If you receive an email that appears to be from House of Hummingbird that you suspect is fraudulent, do not click on any links contained within the email or provide any credit card or log on details. It is usually best to delete emails that you are unsure of.

General

 This contract is governed by the law of England and Wales.

 All images displayed on this website are the sole property of House of Hummingbird, including and not limited to the design, text, graphic, layout, appearance and images.  Any use of the website contents including copying and storing images without prior permission is prohibited.

Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.

House of Hummingbird reserves the right to amend their Terms and Conditions, prices and description of goods at any time without notice.
